EDF’s appeal rejected, KHNP can build Dukovany NPP

The appeal of French EDF over the Dukovany Nuclear Power Plant II tender was dismissed by the Czech Office for the Protection of Competition. The decision has cleared the way for the signing of contracts with Korea Hydro & Nuclear Power (KHNP).

The decision of the authority confirmed an earlier verdict that EDF did not have the possibility to raise objections and, consequently, did not have the possibility to submit an application to the office, as the Czech company proceeded on the basis of the safety exception of the Public Procurement Act.

However, the authority referred EDF to the possibility of judicial protection, which has the possibility to file an action against the decision at the Regional Court in Brno.

Three other decisions related to the contract in question were also issued today. In the first, the chairman of the authority closed the administrative proceedings initiated at the request of Westinghouse Electric Company, in view of the withdrawal of both the application and the appeal. In the other two, the appeals against the decision on the participation of the preferred supplier KHNP in the administrative proceedings were dismissed.

The Czech government announced last July that KHNP is the preferred supplier for constructing the two nuclear units at the Dukovany site.
