Law No. 7554 Begins Super Permit Period in the Energy Sector

Law No. 7554, passed by the Turkish Grand National Assembly on July 19, 2025, introduces many significant changes in the areas of environment, mining, energy, and zoning. The new provisions, particularly concerning critical issues such as rehabilitation obligations, mining in olive groves, EIA processes, and the opening of forest and pasture lands to energy projects, are noteworthy.
- Applications can be made without EIA, but implementation will not be possible.
- The opinions of institutions that do not submit an opinion within three months of the EIA process will be considered positive.
- The rehabilitation fee has been redefined as 100% of the license fee .
- Mining in olive groves became possible with the condition of public benefit and the obligation to plant saplings.
- Urgent expropriation and compulsory stockpiling were made possible for strategic and critical minerals .
- Forest and pasture areas can be allocated to renewable energy projects.
- An amnesty was introduced for construction permits for solar power plants and wind power plants projects .
- Zoning plan and permit procedures can now be carried out directly by the Ministry.
- Investment, incentives and licenses cannot be granted unless an EIA Positive Decision is received.
- However, an application can be made without this decision.
- The review period is three months; if no response is received, it will be considered positive. A maximum of one month's extension may be granted.
- The old “environmental compatibility guarantee” was abolished and replaced by a rehabilitation fee .
- The fee will be 100% of the license fee .
- It will only be used for rehabilitation and cannot be transferred or seized for any other purpose.
- Mining in olive groves is possible provided that alternative land cannot be found and it is in the public interest .
- Olive trees will be moved or new olive fields at least twice as large will be established.
- A rehabilitation fee will also be collected for each year.
- Minerals important for national security and security of supply were defined within this scope.
- Urgent expropriation can be made for these mines.
- Mandatory stock quantities will be determined by the President.
- Permits may be granted on forest lands for the duration of the preliminary license for solar power plant and wind power plant projects.
- An amnesty for unlicensed construction has been introduced for licensed energy facilities that are operational by December 31, 2024, with a certificate of conformity.
- This document will replace the business license and administrative sanctions will be cancelled.
- Zoning plans and building permits for solar power plants and wind power plants projects can now be approved directly by the Ministry.
- Ministry-approved plans will be deemed finalized at the end of the announcement period.
Law No. 7554 initiates a structural transformation in Turkey's environmental, mining, and energy policies. The fundamental cornerstone of this legal framework is, in particular, the acceleration of investment processes, the formalization of environmental audits, and the strengthening of public interest-focused decision-making mechanisms.
