EMRA's draft regulation has been published

The Energy Market Regulatory Authority (EPDK) has taken a significant step regarding unlicensed generation in the electricity market. The "Draft Regulation Amending the Regulation on Unlicensed Electricity Generation in the Electricity Market" has been prepared and submitted for public comment by the close of business on August 1, 2025. It is expected that the final text will be shaped by evaluations and suggestions from relevant individuals, institutions, and organizations during this process.
TRANSPARENCY AND EQUALITY ARE AIMED IN APPLICATIONSThe draft legislation focuses on addressing some technical and administrative issues encountered in the unlicensed electricity generation process. The regulation, aimed at ensuring transparency and equality in the application process, has revisited numerous technical details, including the transfer of production facilities, application priority, and evaluation criteria. Prioritizing facilities based on renewable energy sources is particularly emphasized, while factors such as consumption volume, contract strength, and technical suitability will also be decisive in application prioritization.
TECHNICAL EVALUATION CRITERIA ARE BEING UPDATEDThe new regulation also redefines technical assessment processes. Applications will be carefully scrutinized for their relationship with the metering point and consumption facilities, and all application criteria must be met. If any required documentation is missing, the applicant will be given a period to correct it. However, if compliance is not achieved within this period, the application will be deemed invalid.
NEW PROCEDURES ARE COMING IN CONNECTION PROCESSESChanges are also being made to the connection opinion creation and call letter process. Technical assessment reports for applications based on resources such as geothermal, biomass, wind, and solar will be completed within specific timeframes. Eligible applicants must submit their applications in writing within one month of the announced date. Positive connection opinions of those who fail to take action within this timeframe will automatically be invalidated.
HEAVY SANCTIONS ARE COMING FOR UNAUTHORIZED FACILITIESThe regulation envisages serious sanctions against facilities that engage in unauthorized production. Any production facility established and operating without completing the approval process will be immediately disconnected from the grid, and all installed equipment will be removed from the parcel within sixty days. Even if a connection agreement is signed, no payment will be made for the energy these facilities contribute to the system. These individuals or institutions will be prohibited from submitting new applications for three years.
PLANNED AND SAFE ENERGY TRANSFORMATIONThe aim of all these regulations is to ensure uniformity of application in the area of unlicensed generation, prevent abuse, and support the energy transition in a planned manner. EMRA welcomes feedback from all stakeholders who wish to contribute to this critical regulation.
Comments can be submitted in Word format to [email protected] by August 1, 2025, using the "comment form" provided by the Energy Market Regulatory Authority. They must also be submitted in writing to the Authority's Electricity Market Department.
